Terms of Use
Popbye: Ad Blocker for Safari · Last updated: 23 October 2026
1. Agreement
These Terms of Use ("Terms") are an agreement between you and NEMESIDA SMART DATA LTD, a company registered in Cyprus under number HE 465547, with its registered office at Theofilou Georgiadi 3E, Agios Athanasios, 4103 Limassol, Cyprus ("we", "us"). They govern your use of the Popbye: Ad Blocker for Safari app for iOS and its Safari extensions ("Popbye", "the app").
By downloading or using the app you accept these Terms and our Privacy Policy. If you do not agree, do not use the app.
These Terms are our end-user license agreement for the app and apply instead of Apple's Licensed Application End User License Agreement (the "Standard EULA"), except where section 9 refers to Apple's terms. Your use of the App Store is also subject to Apple's Media Services Terms and Conditions.
2. Eligibility and license
You must be at least 16 years old to use the app, or use it with the permission of a parent or guardian.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions. The app is licensed, not sold. We keep all rights not expressly granted to you.
3. What Popbye does and its limits
Popbye gives Safari lists of rules that hide ads, pop-ups, cookie banners, social widgets and trackers on web pages. Safari applies the rules itself; Popbye doesn't see the pages you visit.
- Safari only. Popbye works only in Safari on iPhone. It doesn't block ads in other apps, in games or in other browsers. No app on iPhone can block ads inside other apps.
- You turn it on. Popbye's blockers work only after you turn them on in Settings → Apps → Safari → Extensions (Settings → Safari → Extensions on iOS 17). iOS updates may turn them off; the app shows when this happens.
- YouTube Shield works only on youtube.com in Safari, not in the YouTube app. YouTube often changes its website and its ads, so YouTube Shield may temporarily stop skipping some ads until we update it.
- Not every ad. Popbye relies on filter lists and on how websites are built. Some ads may still appear, and some websites may not work correctly with blocking turned on. You can pause Popbye on any site and tell us about the problem through Site Doesn't Work in Safari's Share menu.
- Websites' own rules. Some websites ask visitors to turn off ad blockers or limit their content when ads are blocked. You are responsible for following the terms of the websites you visit.
4. Free basic mode and Popbye Pro
Basic ad blocking (ads, plus a regional list chosen from your iPhone's language) is free. A Popbye Pro subscription adds blocking of cookie banners and pop-ups, social widgets, Tracker Blocker, YouTube Shield and Hide an Element.
- Plans. Popbye Pro is offered as auto-renewable weekly and yearly subscriptions. Prices, any free trial and any introductory price are shown in the app before purchase and may differ by country.
- Billing. Payment is charged to your Apple Account at confirmation of purchase, or at the end of a free trial if you do not cancel before it ends.
- Auto-renewal. Your subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Free trials and introductory offers. A free trial or an introductory price, where offered, is available once per Apple Account within the Popbye Pro subscription group. If you buy a subscription during a free trial, the unused part of the trial ends.
- Cancellation. Manage or cancel your subscription in Settings → [your name] → Subscriptions, or from the app's Settings. Deleting the app does not cancel your subscription. After cancellation, Popbye Pro stays active until the end of the paid period; after that, only the free features keep working.
- Price changes. If the price changes, Apple will notify you and, where required, ask for your consent before the next renewal.
- Refunds. Payments are processed by Apple. Refund requests are handled by Apple under its policies at reportaproblem.apple.com. This does not affect your statutory consumer rights.
5. Filter lists
Popbye's blocking rules are converted from third-party filter lists whose licenses allow commercial use, including lists of the EasyList family. The converted lists are shared under the Creative Commons Attribution-ShareAlike 3.0 license (CC BY-SA 3.0). Their authors and licenses are listed in the app under Settings → Filter Lists & Licenses. The authors of the filter lists are not affiliated with us and do not endorse Popbye.
6. Acceptable use and intellectual property
You agree not to copy, modify, distribute, sell or lease the app; reverse engineer or attempt to extract its source code, except where the law allows; bypass subscription checks or other technical restrictions; or use the app in violation of any law.
The app, its design, code, texts and the Popbye name and logo belong to us or our licensors and are protected by intellectual property laws. The filter lists remain subject to their own licenses described in section 5. Apple, iPhone, Safari and App Store are trademarks of Apple Inc. YouTube is a trademark of Google LLC. Popbye is not affiliated with or endorsed by Apple or Google.
7. Disclaimers and limitation of liability
To the extent permitted by law, the app is provided "as is" and "as available". We do not guarantee that it will be error-free, that it will block every ad, pop-up or tracker, or that every website will work correctly with it.
To the extent permitted by law, we are not liable for indirect, incidental or consequential losses. Our total liability for any claim related to the app is limited to the amount you paid for Popbye Pro in the 12 months before the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or any other liability that cannot be limited by law, and nothing affects your statutory rights as a consumer.
8. Changes, termination and governing law
- Changes to the app. We may update, change or discontinue features of the app, for example when Safari, iOS or websites change.
- Changes to these Terms. We may update these Terms. We will publish the new version at popbye.app/terms with a new "Last updated" date and, for material changes, inform you in the app. If you continue to use the app after the change, the new Terms apply.
- Termination. You may stop using the app at any time by deleting it; cancel your subscription separately as described in section 4. We may suspend or end your license if you materially breach these Terms.
- Governing law. These Terms are governed by the laws of the Republic of Cyprus. Disputes are subject to the courts of Cyprus. If you are a consumer, you also keep the protection of the mandatory laws of your country of residence and may bring a claim in the courts there.
9. Terms required by Apple
The following applies because the app is distributed through the App Store:
- These Terms are between you and us only, not with Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app. Support is provided by us at support@popbye.app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
- We, not Apple, are responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes its intellectual property rights, we, not Apple, are responsible for the investigation, defense, settlement and discharge of that claim.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right to enforce them against you as a third-party beneficiary.
